The most persistent criticism of grand juries is that jurors are not a representative sampling of the community, and are not qualified for jury service, in that they do not possess a satisfactory ability to ask pertinent questions, or sufficient understanding of local government and the concept of due process.[21] Unlike potential jurors in regular trials, grand jurors are not screened for bias or other improper factors. They are rarely read any instruction on the law, as this is not a requirement; their job is only to judge on what the prosecutor produced. The prosecutor drafts the charges and decides which witnesses to call.[9] The prosecutor is not obliged to present evidence in favor of those being investigated. Grand jury witnesses have no right to have a lawyer or family in the room, and can be charged with holding the court in contempt (punishable with incarceration for the remaining term of the grand jury) if they refuse to appear before the jury[22] and all evidence is presented by a prosecutor in a cloak of secrecy, as the prosecutor, grand jurors, and the grand jury stenographer are prohibited from disclosing what happened before the grand jury, unless ordered to do so in a judicial proceeding.

Grand Jury Convened in Oakland County Child Killer Case Hearing Evidence for Over a Month

Sources confirm to Fox 2 that a grand jury has been seated in the Oakland County Child Killer case, and they've been working for over month. We're told the Oakland County Circuit Court empanneled an 18 member jury to hear evidence relating to that case, as well as several other cold cases in Oakland County.
Even though grand juries are commonly used by federal courts, it's very rare for counties to convene them.
This is a move the families of the victims have been requesting for some time. Many of them believe the police investigation has been taking too long, over 30 y ears now, without a conviction. Four children were abducted, raped and killed in 1976 and 1977.
Their families think a grand jury may be the only way to bring some of the evidence to light and find the truth. Fox 2 Legal Analyst Charlie Langton thinks they may have a point, simply because of the secretive way a grand jury operates.
By law, the prosecutor, the judges who empanneled it, not even the grand jurors themselves are allowed to say anything about the process. The only people who can say anything about it are the witnesses called to testify.
