UPDATED: 1:20 pm EDT October 18, 2007 For the first time in a 30 year investigation, a civil lawsuit has been filed by the family of a child who died at the hands police call the Oakland County Child Killer. The wrongful death lawsuit names Ted Lamborgine, 65, as one of the group who collectively raped and murdered several children in the '70s and '80s. The family of Mark Stebbins, one of the children slain, filed the lawsuit against Lamborgine. "The police have the burden of proof beyond a reasonable doubt. In a civil lawsuit, we don't have that same burden. Ours is more likely than not," said David Brinkley. "Under the circumstances, we believe we can utilize techniques a civil lawsuit permits and we believe we could perhaps push the investigation a little further." Brinkley said the evidence includes statements made in a separate child molestation case against Lamborgine, where a boy claims he was sexually molested and nearly suffocated to death in Royal Oak. Lamborgine was charged last year with molesting six children in the Cass Corridor in the 70s and 80s. Police said he would lure boys in with food, soda and drugs for the purpose of sexually assaulting them. The new suit will give attorneys new subpoena powers against Lamborgine and others that may have information about the case. The Stebbins family is not seeking monetary damages. They said they are only filing the lawsuit to help in the investigation to get everyone responsible in jail. The family of Timothy King is also expected to join in on the lawsuit. Prosecutors said Lamborgine and Richard Lawson, who is already serving a life sentence for murder were part of a sex ring. The two are accused of molesting 12 boys. Mark Douglas Stebbins was a strawberry blond,a quit boy,some what of a loner.and a good student.He lived in Ferndale,not far from Birmingham,Mi.Mark,was twelve years old the day he left the American Legion Hall in Ferndale where he had gone to see his Mother.At the time no one knew this would be the last time he would be see alive,as he was to become the first of four children,between the ages of 10 and 12-who would be abducted and killed in towns in and around Oakland County,a suburban area north of Detroit.-Authorities said the children were held from four to 19 days before being killed.They had all been bathed and fed after being abducted,thus earning the offender the nickname the Babysitter-.Authorities,depending on who you talk to give two different methods for Marks death-one that he was strangled...another that he was smothered....insignificant of course...as in the end...the results remain that Mark,was dead.His body found four days after his abduction in a parking lot,fully clothed in the same blue parka,jeans,red sweatshirt,and black rubber boots..he was not wearing any shoes-.Today Mark-Twenty Nine years after your death...the world still remembers....and they know your name...and are still seaching for your killer...and just maybe-next year on the 30 anniversary,there maybe someone in custody,who will be standing trial,for the murders of the four OAKLAND COUNTY CHILD SLAYINGS.

Suit Alleges Key Suspect and Convicted Sex Offender Involved in Crime 3:00pm ET Press Conference Scheduled PONTIAC, Mich., Oct. 18 /PRNewswire/-- A key suspect serving three life sentences for sexual assaults on children has been named in a wrongful death lawsuit, filed today by a private Oakland County lawyer. Lamborgine is a former Detroit resident and Ford autoworker with a history of sexual assaults on children. During the 1970s and 80s, Lamborgine was allegedly involved in a child sex ring in Detroit's Cass Corridor, which led to charges in a series of child sex crimes. In April 2007, Lamborgine pleaded guilty to all 14 counts, three of which involved children who were younger than 13 years old. He is serving his sentence in the Macomb Correctional Facility in New Haven. Mr. Binkley is a member of the firm's business litigation group. I posted this in 2007 after the Law Suit had been filed--Let me start with something very important-I do not plan on repeating it-as this statement will hold true for the duration of this Civil Suit-anything I say is not meant to have any disrespect to the victim's families or their attorneys or in any way to question their motives....as they are being led astray by the Occk Task Force and the FBI in a self serving attempt to falsely assign guilt to some one who obviously did not kill or take part in the murders of these four Oakland County Children,according to the facts of this case....How can I say this? Because I have worked 10-12 hours a day 7 days a week on these cases and...nowhere does it show any connection to Ted or any of the Cass Corridor suspects! Can I prove this-yes ?I can!...and even though I never violate any sources information...I am stating right here-that if that is what it takes to save a man from being convicted ...wrongfully and there by taking any investigative heat off the real killer ....I may have to go back on my word and reveal some of my confidential information.{but not the sources}..So this is my suggestion-If you will have a problem with my decision regarding this...Do not give me any more confidential information until the Civil Suit is over....(4-23-2013,will be continued with the confidential Info)

Friday, October 19, 2007 Victim's family in Oakland child killings sues molester over death Mike Martindale / The Detroit News PONTIAC -- The family of a victim in the Oakland County child killings filed a wrongful death lawsuit Thursday against admitted child molester Theodore Lamborgine.
The lawsuit alleges Lamborgine, 66, an ex-Ford autoworker who lived in Metro Detroit in the late 1970s, abducted Mark Stebbins, 12, of Ferndale and held him captive in a Royal Oak house for four days in February 1976 before smothering him to death during a sex assault.
Lamborgine has never been formally linked, let alone charged in the death of Stebbins, the first of four children who were abducted and slain between February 1976 and March 1977. Attorney David A. Binkley seeks compensation, including funeral costs, for Stebbins' brother, Michael, but stressed money is secondary. "We want to prove Ted Lamborgine did not act alone, that there are others still out there who are also responsible and they too have to answer for what they did to the victims and the victims' families," Binkley said.
Oakland County Sheriff Michael Bouchard knows Lamborgine is a pedophile but is not convinced he's responsible for the Oakland County child killings.
"I have no doubt he seriously damaged some boys' lives, but I haven't heard anything to link him to the Oakland County deaths," said Bouchard. "If we had any evidence, we would have charged him. It's possible he may have information, but I don't think he's the one."
State Police detectives have long suspected that Lamborgine -- part of a pedophile sex ring in the Cass Corridor 30 years ago -- knows something. In April he refused to take a polygraph exam about his knowledge despite being offered a plea bargain of a minimum 15-year prison sentence, rather than life, on his conviction of 14 sex-related crimes involving young boys.
"He never even denied having knowledge but only said 'God has forgiven me,' " said Binkley. "Wouldn't you deny being the Oakland County child killer?"
Binkley added victim's statements made at Lamborgine's trial in Wayne Circuit Court have disturbing similarities to the methods of the child killer.
"One victim said,'You know what you did to me when you took me to the house in Royal Oak and then tried to smother me,' said Binkley, noting it revealed Lamborgine's crimes extended into Oakland County, where three victims were smothered.
"In criminal cases police and prosecutors must prove a case beyond a reasonable doubt," said Binkley. "In a civil lawsuit, the burden of proof is the preponderance of evidence -- more likely than not, or 51 percent.
"We believe evidence will show he killed Mark Stebbins."
The lawsuit is assigned to Oakland Circuit Judge Steven N. Andrews.

The Attorney for this bogus suit .was David A. Brinkley -I knew from the start that this guy wasn't going to be able to take this case to where it needed to go-as he in his self ,I learned was a real piece of work-to begin with he stated on a Detroit Free Press blog,that he was offering his services at no charge-Really?Well in his Complaint and Jury demand-in less than 2 pages he mention money 6 times and that doesn't count the original statement,his request for 25,000 bucks- and requested an award of damages and cost,interest and actual attorney fees-as he knew Theodore Lamborgine -had a auto pension coming in---but that is not what P--' me off-I had received some info in that mention Mark Stebbins,so I sent it to him and it was and still is a great Tip....He mails me back a brief nasty email,telling me -that isn't true Bla Bla Bla-*Yet he knows full well at the time-that Ted is not the Occk and that he is just playing a little game with the courts-Here is some of that Info-*Helen I reported my thoughts over 30yrsa go to Det. Robertson. I never have heard any feedback so I have obsessed yrs over this. The mans name is Xxxxxx he was a psychiatrist, now I believe a pharmacist. I put a house cleaning add in a local paper, he called but gave a different name. He explained later he had given me his phone name. The name thing and his extreme cleanliness got my mind going . I am not a nosy person but felt justified because of who I thought he could be. I did find id in the other name in his house. I also found a journal which he started just weeks before Mark was taken and stopped just days before he was taken. In it he said"lately I have begun to love watching and being around children, those children 12-15 who seem to have no sense but have such a marvelous time" very odd thing I thought for a man to write. He also listed adjectives describing his loneliness and one was murderous, very odd again. He had a very bizarre lawsuit from a patient he held at Ardmore Acres. Xxxxxxxx V Xxxxxxxx. He would have been privvy to any meds. On your site I saw a Lemans was a possibility. I am not good with models but told Robertson back then that I thought he drove a Lemans, Another interesting point was on your site I saw the bumper may have had a hitch on it. I never saw his car close enough to know about a hitch but I do know he had a boat in his garage on a trailer. This was all just months after all the kids had been taken. Also, Ardmore hospital was very close to Tims drop off and again from your site I read someone had to have known the area well. He moved to NY for awhile after I stopped cleaning for him, He now lives in Ann Arbor, is 80, has had homes in walled lake, Farmington, Alpena and I believe Livonia. What do you think Helen?--------------------- Note:*-I did not include this info in with the above that I had sent to David A. Brinkley- But I also had met this Dr. -In Alpena Mi-I had to go to him for my per-sentencing report-and his solution for me -was to run away to Russia with him and live the good life that he could provide- This was years before I knew a thing about the Occk...

Man rejected deal involving Oakland County child deaths 3/22/2006, 1:11 p.m. ET The Associated Press DETROIT (AP) — A 60-year-old murder convict who gave police information about four Oakland County child killings in the 1970s rejected a deal that would have allowed him to serve his sentence in the prison of his choice, his lawyer says. The deal would have required Richard Lawson to tell all he knows about four Oakland County child killings in the 1970s, defense lawyer James O'Donnell told the Detroit Free Press. Lawson was found guilty March 7 of first-degree murder and armed robbery in Wayne County Circuit Court in the 1989 death of Exavor Giller, 67. On Tuesday, a judge handed down the life with no parole sentence that is automatic for first-degree murder in Michigan. Information that Lawson has given police in the past year and a half has spurred new activity in the investigation of the child killings. His statements have led police to Detroit's Cass Avenue corridor, a neighborhood that was a center for prostitution and pornography at the time of the killings. The deaths of 11-year-old Timothy King, 12-year-old Mark Stebbins, 12-year-old Jill Robinson and 10-year-old Kristine Mihelich horrified the Detroit area. All four were abducted from business areas in suburban Oakland County and found suffocated between February 1976 and March 1977. Two had been raped, and one also was shot in the face with a shotgun. In a jailhouse interview with WJBK-TV in Detroit that aired Tuesday night, Lawson said he believed the owner of a bicycle shop in the Cass corridor, Bobby Moore, may have been the killer. Moore died of natural causes in 1996, said State Police Detective Sgt. Garry Gray, who is leading the investigation. Gray confirmed that police are investigating Moore's possible role based on Lawson's statements. He said there are several other suspects. Lawson told WJBK that he had no involvement in the killings, and Gray said he had passed a lie-detector test to that effect. Gray said he did not know whether or not Lawson had any other information that could help investigators. "I think he's just playing games right now," Gray said. "We're not playing games." Wayne County Prosecutor Kym Worthy said Lawson's refusal of the offer has not stopped the investigation. "I would especially like the families of the victims to know that our first priority is seeing that justice is served," Worthy said in a statement. "We hope there will be a resolution to this case that has haunted Michigan for three decades."

Thanks, Helen. I am never giving up. I just want someone in LE to put the full court press on the Hastings clan, ASAP, before they start dying off. I will support you, the King family and anyone else truly seeking justice in the case, in any way I can. It's been 31 years since the OCCK Task Force was formulated. What do we have to show for our tax dollars? A few know-it-all, big-ego detectives sitting on their asses all day long with no real results after all of these years. What a sad,sad joke. You know, the UAW used to have a "30 and out" slogan for their workers. Perhaps its time for these guys to retire so we can get some new, fresh eyes on this case. It can't hurt at this point. The worst we could get is the same inaction and incompetence. I wonder what the task force is doing at this very moment. They probably have their feet up on their desk talking about their old LE cronies, laughing , joking around. Perhaps they are playing "Solitaire" at their desks. Or perhaps they are looking into their pedophile list to see who they can pin the blame on next time; after this current Ted Lamborgine witch hunt ends. Perhaps I got up on the wrong side of the bed this morning but for some reason,I am very angry that LE has done zilch. Somebody out there killed these 4 kids and they have had 30+ years to solve it. I feel bad for these families and even worse knowing that someone got away with it...to this point.

So, I will instead focus on the powerful acts of kindness and commitment shown by you, Cory, Judi, Art, and the retired cop who also helped me realize how f--ked up the investigation really was (he wants to remain nameless unless we need him). It is truly awe-inspiring. Just one person can touch the entire universe--you go to the cops to tell them about John, they blow you off, you start a website which causes others to become aware and involved, I check out your site and hook up with you and Judi and Art (he wanted to tell me first hand about the Big Boy deal), had I not had my eyes opened, I would have not paid any attention to the things that followed. I would have just ignored them, thinking "oh the cops will check this out fully" (I think Cory now understands that NONE of the prior work can be trusted). I would have continued to live my life the way I had for the past three decades--by shoving the crime out of my head. Helen, coming across the few committed people who care (my list above) is great compensation for the tragic errors that preceded your effort and Cory's effort. It restores my faith in humanity.
